Timeline

After engaging MICS and paying the initial professional fee, MICS will analyze the client’s profile and foreign business structure while initiating U.S. market research. MICS’ legal team will identify a regional approved center for the investor and file Form I-526 (Immigrant Petition by Standalone Investor) or Form I-526E (Immigrant Petition by Regional Center Investor) with USCIS upon receiving the required documents. The client will then transfer the investment funds to the designated EB-5 enterprise.

MICS will apply for Conditional Lawful Permanent Residence (CLPR) for the client and their family. This can be done through consular processing for those outside the U.S, or by filing Form I-485 (Application to Register Permanent Residence or Adjust Status) for those already in the U.S. If consular processing is needed, MICS will arrange the immigrant visa interview with the U.S. Department of State. Once the client receives the immigrant visa, they can enter the U.S. with CLPR status, triggering the second payment of MICS’ professional fee. If adjustment of status is applicable, MICS will submit Form I-485 to USCIS.

Once the Form I-526 petition is approved and either the immigrant visa is issued or the Form I-485 is processed, the client and their family members will be granted conditional permanent residence for two years.

After two years, MICS will file Form I-829 (Petition by Investor to Remove Conditions on Permanent Resident Status) with USCIS. This includes evidence of maintaining the investment and job creation. The filing must be done within the 90-day period immediately before the second anniversary of the client’s adjustment of status or admission to the U.S. as a conditional permanent resident. The remaining balance of MICS‘ professional fee is due at this stage.

Upon approval of the Form I-829 petition, USCIS will remove the conditions from the client’s and their family members’ lawful permanent resident status, and they will be issued a 10-year green card. This green card is renewable every 10 years with continued U.S. residence.
